General Terms and Conditions – Evolation Yoga
1.1 Applicability
These general terms and conditions apply to all agreements for participation in trainings, retreats, workshops, courses, and other activities organized by Evolation Yoga, located in Amsterdam. Deviations are only valid if agreed upon in writing.
1.2 Registration and Formation of Agreement
An agreement is established once the participant registers via the registration form and the registration has been confirmed in writing by Evolation Yoga via e-mail. Evolation Yoga reserves the right to refuse a registration without stating any reason.
1.3 Guarantee and Performance Provisions
Evolation Yoga will make every effort to carry out the training to the best of its knowledge and ability, and in accordance with the standards of good professional practice. No guarantee is given that the participant will achieve a specific result or obtain a diploma.
1.4 Reflection Period and Withdrawal (Consumers)
If registration has taken place remotely (such as by e-mail or via an online form), the participant acting as a consumer has the right to a reflection period of fourteen (14) days after confirmation of registration. Within this period, the participant may withdraw from the agreement free of charge, provided that the training has not yet started.
1.5 Payment
After confirmation of registration, the participant will receive an invoice. Payment must be made within fourteen (14) days of the invoice date, unless otherwise agreed in writing. If payment is not received on time, Evolation Yoga reserves the right to unilaterally cancel the participation, in which case the cancellation policy remains applicable.
1.6 Cancellation by the Participant
Cancellation must be submitted in writing (by e-mail or registered mail).
For cancellations more than thirty (30) days before the start of the training, the participant is entitled to a refund of the full amount, minus an administration and registration fee of €1,000.
For cancellations within thirty (30) days before the start of the training, no refund will be given.
In cases of demonstrable force majeure, such as serious illness or death of a close relative, it will be assessed in consultation whether (partial) refund or transfer to another training date is reasonable. Medical documentation may be required.
1.7 Cancellation or Changes by Evolation Yoga
Evolation Yoga reserves the right to cancel or reschedule a training in the event of insufficient registrations, illness of teachers, or other force majeure situations. In such cases, participants will receive a full refund of any fees already paid, unless an alternative date is accepted.
1.8 Intellectual Property
All materials, videos, handouts, texts, recordings, and other content provided by Evolation Yoga are protected by copyright. Without written permission, it is not permitted to reproduce, edit, distribute, or use this material for commercial purposes.
1.9 Liability
Evolation Yoga is only liable for direct damages resulting from intent or gross negligence on its part. Any other liability, such as consequential damage, personal injury, or damages due to personal circumstances of the participant, is excluded. Participation in trainings is at the participant’s own risk.
1.10 Complaints Procedure
For our detailed complaints procedure, please refer to the Grievance Policy section in the document Consistency Guidelines and Code of Conduct. In cases where this procedure proves insufficient, complaints can be submitted to an independent third party:

1.11 Governing Law and Jurisdiction
These terms and conditions are governed by Dutch law. Disputes arising from this agreement will, unless otherwise required by mandatory law, be submitted to the competent court in the Netherlands. For registrations for trainings held by Evolation Yoga in the United States, only the laws of the United States apply. For all other locations and agreements, only Dutch law applies. Disputes will, unless otherwise required by mandatory law, be submitted to the competent court in the country whose law is applicable.
Algemene voorwaarden – Evolation Yoga
1.1 Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op alle overeenkomsten voor deelname aan opleidingen, retraites, workshops, trainingen en overige activiteiten die door Evolation Yoga, gevestigd te Amsterdam, worden georganiseerd. Afwijkingen zijn slechts geldig indien schriftelijk overeengekomen.
1.2 Inschrijving en totstandkoming overeenkomst
Een overeenkomst komt tot stand op het moment dat de deelnemer zich via het aanmeldformulier inschrijft en deze inschrijving door Evolation Yoga schriftelijk per e- mail is bevestigd. Evolation Yoga heeft het recht om een inschrijving zonder opgave van redenen te weigeren.
1.3 Garantiebepalingen
Evolation Yoga spant zich in om de trainingen naar beste inzicht en vermogen en overeenkomstig de eisen van goed vakmanschap uit te voeren. Er wordt geen garantie gegeven dat de deelnemer een bepaald resultaat of diploma behaalt.
1.4 Bedenktijd en herroeping (consumenten)
Indien de inschrijving op afstand (zoals via e-mail of een online formulier) heeft plaatsgevonden, heeft de deelnemer die handelt als consument recht op een bedenktijd van veertien (14) dagen na bevestiging van inschrijving. Binnen deze termijn kan de deelnemer de overeenkomst kosteloos ontbinden, mits de opleiding nog niet is aangevangen.
1.5 Betaling
De deelnemer ontvangt na bevestiging van inschrijving een factuur. Betaling dient te geschieden binnen veertien (14) dagen na factuurdatum, tenzij schriftelijk anders is overeengekomen. Bij uitblijven van tijdige betaling is Evolation Yoga gerechtigd de deelname eenzijdig te annuleren, waarbij de annuleringsvoorwaarden van toepassing blijven.
1.6 Annulering door de deelnemer
Annulering dient schriftelijk (per e-mail of aangetekend) te gebeuren. - Bij annulering meer dan dertig (30) dagen voor aanvang van de training, heeft de deelnemer recht op restitutie van het volledige bedrag, verminderd met een administratie- en inschrijvingsvergoeding van € 1.000,-. - Bij annulering binnen dertig (30) dagen voor aanvang van de training, vindt geen restitutie plaats. - In geval van aantoonbare overmacht, zoals ernstige ziekte of overlijden van een naaste, zal in overleg worden beoordeeld of (gedeeltelijke) restitutie dan wel overdracht naar een andere trainingsdatum redelijk is. Medische bewijsstukken kunnen worden verlangd.
1.7 Annulering of wijziging door Evolation Yoga
Evolation Yoga behoudt zich het recht voor een training te annuleren of te verplaatsen in geval van onvoldoende inschrijvingen, ziekte van docenten of andere overmachtsituaties. Deelnemers ontvangen in dat geval het volledige reeds betaalde bedrag terug, tenzij een alternatieve datum wordt aanvaard.
1.8 Intellectueel eigendom
Alle door Evolation Yoga verstrekte materialen, video’s, hand-outs, teksten, opnames en andere content vallen onder auteursrechtelijke bescherming. Zonder schriftelijke toestemming is het niet toegestaan dit materiaal te vermenigvuldigen, bewerken, verspreiden of te gebruiken voor commerciële doeleinden.
1.9 Aansprakelijkheid
Evolation Yoga is uitsluitend aansprakelijk voor directe schade die het gevolg is van opzet of grove nalatigheid van haar zijde. Iedere andere aansprakelijkheid, zoals gevolgschade, letselschade of schade door persoonlijke omstandigheden van de deelnemer, is uitgesloten. Deelname aan trainingen geschiedt op eigen risico.
1.9 Klachtenregeling
Voor onze uitgebreide klachtenprocedure verwijzen wij naar het onderdeel Grievance Policy in het document Consistency Guidelines and Code of Conduct. In situaties waarin deze klachtenprocedure niet voldoende blijkt, kan men zich richten naar de onafhankelijke derde, namelijk: Vereniging Yogadocenten Nederland, Roderweg 7 , 9321 AA Peize, Nederland. 1.10 Toepasselijk recht en bevoegde rechter
Op deze voorwaarden is Nederlands recht van toepassing. Geschillen die voortvloeien uit deze overeenkomst worden, tenzij dwingendrechtelijk anders bepaald, voorgelegd aan de bevoegde rechter te Nederland. Voor inschrijvingen voor trainingen van Evolation Yoga die plaatsvinden in de Verenigde Staten is uitsluitend het recht van de Verenigde Staten van toepassing. Voor alle andere locaties en overeenkomsten is uitsluitend Nederlands recht van toepassing. Geschillen worden, tenzij dwingendrechtelijk anders bepaald, voorgelegd aan de bevoegde rechter in het land waarvan het recht van toepassing is.
